Professor Jill Wieber Lens's most recent article, "Justice Holmes's Bad Man and the Depleted Purposes of Punitive Damages," recently made the Social Science Research Network's Top Ten most downloaded list for the "Legal Scholarship Network: Remedies and Judgments Journal." The ranking is based on the number of downloads between August 22, 2012 through October 10, 2012. The article was also cited on TortsProf Blog.
Briefly, the article addresses the U.S. Supreme Court's treatment of punitive damages' common law purposes in Exxon Shipping Co., and argues that the court undermined those purposes and thus undermined the damages. The article can be downloaded at papers.ssrn.com.
The article will be published in the spring in the 101st volume of the Kentucky Law Journal. The Kentucky Law Journal is the 10th oldest academic law review in continuous publication and has a strong tradition of scholarship.
